Absolutely, yes to both.
Yes, the license and even if the insurance is necessary if New York City - is the state where I live.

If you drive a 49 cc scooter on the road itself must TSO course every vehicle that is on the way, must be insured. In 125 cc, you must have a full motorcycle license.
